Terms of Use

1. Agreement

These Terms of Use govern access to and use of Timing Plus services and the website www.timingplus.com.au. By using our services or website, you agree to these Terms.

Provider: The Trustee for The Minifies Trust trading as Timing Plus ABN 94 110 042 700.

2. Services and scope

Timing Plus provides timing services for cross country running events. Services are provided on a per-event basis and invoiced post-event. Timing Plus does not provide subscription services.

3. Customer responsibilities

Customers must:

• Provide accurate competitor data.
• Confirm they have obtained parental/guardian consent for all children under 16.
• Provide required on-site facilities, including: power, safe antenna placement, shelter, table and chair, and event marshals to direct competitors across timing mats.
• Ensure data provided is limited to what is necessary for the event.

4. Use restrictions

Users must not:

• Interfere with or attempt to disrupt Timing Plus systems.
• Reverse engineer or attempt to extract source code or proprietary information.
• Use the service for unlawful purposes.

5. Intellectual property

All intellectual property in Timing Plus systems, software and materials remains the property of Timing Plus. Customer data and customer IP remain the property of the customer. Timing Plus is granted a limited licence to use customer data solely to provide the services.

6. Fees, billing and refunds

Fees are agreed per event. Invoicing occurs after the event. Refunds are handled on a case-by-case basis. Timing Plus's maximum aggregate liability is limited to the fees paid by the customer for the specific event.

7. Warranties and disclaimers

Services are provided "as is". Timing Plus makes no warranty of uninterrupted or error-free operation. Timing is subject to missed reads as described in the RFID Acknowledgement below. Timing Plus does not warrant that results will be error-free.

8. Limitation of liability

To the maximum extent permitted by law:

• Timing Plus's aggregate liability for any claim is limited to the fees paid by the customer for the specific event.
• Timing Plus is not liable for indirect, special or consequential loss.

9. Indemnities

No general indemnity is required from the customer. Each party remains responsible for its own acts and omissions.

10. Termination

Either party may terminate services in accordance with the event service agreement. Termination does not affect accrued rights or obligations.

11. Support

Support is provided on an ad-hoc basis. Timing Plus aims to respond to support requests within 5 business days.

12. Governing law and dispute resolution

These Terms are governed by the laws of Queensland, Australia. Parties agree to attempt mediation before commencing court proceedings.

13. Changes

Timing Plus may update these Terms. Material changes will be notified to customers.

Appendix A — RFID timing acknowledgement

RFID timing systems are highly reliable but not infallible. Missed reads can occur due to:

• Tag orientation or placement
• Crumpled or covered bibs
• High speed movement through the read zone
• Environmental interference (metal, water, electronic devices)
• Antenna coverage gaps
• Damaged tags or equipment faults

Timing Plus uses multiple antennas and best-practice setup to reduce missed reads. The customer acknowledges these limitations and agrees that Timing Plus's liability for timing errors is limited to the fees paid for the specific event.
